Copyright and Image Use


International Relations Insights & Analysis (IRIA) is an independent think tank and research publication dedicated to international relations, geopolitics, defense, security, economics and current affairs.

Use of Images and Third-Party Material

IRIA publishes images and other third-party materials in connection with its reporting, analysis, research and commentary concerning current events and matters of public interest.

Where the applicable legal conditions are satisfied, IRIA relies on the copyright exceptions and limitations provided by Romanian law and applicable European Union law.

In particular, Article 35 of Romanian Law No. 8/1996 on Copyright and Related Rights permits certain uses of works that have previously been made available to the public, without the authorization of the copyright holder and without payment of remuneration, subject to the conditions established by law.

Under Article 35, such permitted uses are subject, among other things, to the requirements that they comply with fair practice, do not conflict with the normal exploitation of the work and do not prejudice the author or holders of rights. Article 35(2)(c) further provides for certain reproduction, distribution, broadcasting or communication to the public, without a direct or indirect commercial or economic advantage, of short extracts of works in information concerning current events, but only to the extent justified by the purpose of providing the information.

Where required by law, the source and name of the author are identified, unless this proves impossible.

Editorial and Public-Interest Use

IRIA's website is primarily intended to provide the public with research, analysis, commentary and information concerning international affairs, geopolitics, security and current events.

Images and other third-party materials accompanying IRIA articles may be used in connection with the reporting, explanation, analysis or documentation of matters of public interest where the applicable requirements of Romanian and European Union copyright law are satisfied.

The use of third-party material by IRIA is considered in light of the purpose and circumstances of the particular publication, including the relevance of the material to the information being provided and the extent of the material used.

Copyright Exceptions and Current Events

IRIA recognizes the importance of copyright protection while also relying, where applicable, on statutory exceptions and limitations established for reporting and communicating information concerning current events.

Under applicable European Union law, the current-events exception is intended to permit the use of protected works where their use is justified by the purpose of informing the public about a current event, subject to the applicable legal conditions and the requirement that the use does not improperly interfere with the rights holder's legitimate interests.

IRIA applies these principles to its reporting, research, analysis and commentary concerning matters of public interest.

Attribution

Where required by applicable law, and where the relevant information is available, IRIA identifies the source, author, photographer, agency or other rights holder of third-party material.

Copyright Concerns

Copyright holders who believe that material published by IRIA has been used outside the scope of an applicable copyright exception or other authorization may contact IRIA with details identifying the material and the basis of their claim.

IRIA will review substantiated copyright concerns in light of the applicable law and the circumstances of the particular use. Where appropriate, IRIA may remove, modify or replace the relevant image or other material.
