{"id":22937,"date":"2024-05-21T00:02:00","date_gmt":"2024-05-20T21:02:00","guid":{"rendered":"https:\/\/www.ir-ia.com\/news\/?p=22937"},"modified":"2024-05-20T23:15:22","modified_gmt":"2024-05-20T20:15:22","slug":"international-criminal-court-prosecutor-applies-for-arrest-warrants-for-israeli-and-hamas-leaders","status":"publish","type":"post","link":"https:\/\/www.ir-ia.com\/news\/international-criminal-court-prosecutor-applies-for-arrest-warrants-for-israeli-and-hamas-leaders\/","title":{"rendered":"International Criminal Court prosecutor applies for arrest warrants for Israeli and Hamas leaders"},"content":{"rendered":"\n<p><strong>The International Criminal Court (ICC) prosecutor has formally applied to seek the arrest warrants of Israeli Prime Minister Benjamin Netanyahu and Hamas leader Yahya Sinwar.<\/strong><\/p>\n\n\n\n<p>The two, along with other leaders, have been charged with war crimes and crimes against humanity related to the October 7 attack on Israel by Hamas and the subsequent Israeli invasion of Gaza.<\/p>\n\n\n\n<p>ICC Prosecutor Karim Khan announced on May 20, 2024, that his office had applied for arrest warrants for Israeli and Hamas leaders. Khan said that his office had \u201creasonable grounds\u201c to believe that Israeli Prime Minister Benjamin Netanyahu and Defense Minister Yoav Gallant bear \u201ccriminal responsibility\u201d for \u201cwar crimes and crimes against humanity\u201d.<\/p>\n\n\n\n<p>&#8220;Nobody is above the law,&#8221; said Khan as he and his team announced the charges formally in a <a href=\"https:\/\/www.icc-cpi.int\/news\/statement-icc-prosecutor-karim-aa-khan-kc-applications-arrest-warrants-situation-state\" target=\"_blank\" rel=\"noreferrer noopener\"><mark style=\"background-color:rgba(0, 0, 0, 0);color:#ac0707\" class=\"has-inline-color\">statement<\/mark><\/a> and a video address.<\/p>\n\n\n\n<p>Khan has also applied for arrest warrants for three Hamas leaders, Yahya Sinwar, Mohammed Diab Ibrahim al-Masri (known as Deif), and Ismail Haniyeh, against similar charges. He stated that his team has found evidence suggesting that Israel has \u201cintentionally and systematically deprived the civilian population in all parts of Gaza of objects indispensable to human survival.\u201c<\/p>\n\n\n\n<p><blockquote class=\"twitter-tweet\"><p lang=\"en\" dir=\"ltr\"><a href=\"https:\/\/twitter.com\/hashtag\/ICC?src=hash&amp;ref_src=twsrc%5Etfw\">#ICC<\/a> Prosecutor <a href=\"https:\/\/twitter.com\/KarimKhanQC?ref_src=twsrc%5Etfw\">@KarimKhanQC<\/a> announces applications for arrest warrants in relation to Yahya Sinwar, Mohammed Diab Ibrahim Al-Masri (Deif) and Ismail Haniyeh in the context of the situation in the State of <a href=\"https:\/\/twitter.com\/hashtag\/Palestine?src=hash&amp;ref_src=twsrc%5Etfw\">#Palestine<\/a> \u2935\ufe0f<a href=\"https:\/\/t.co\/WqDZecXFZq\">https:\/\/t.co\/WqDZecXFZq<\/a> <a href=\"https:\/\/t.co\/yXsuzKYlqJ\">pic.twitter.com\/yXsuzKYlqJ<\/a><\/p>\u2014 Int&#8217;l Criminal Court (@IntlCrimCourt) <a href=\"https:\/\/twitter.com\/IntlCrimCourt\/status\/1792511134009856429?ref_src=twsrc%5Etfw\">May 20, 2024<\/a><\/blockquote> <script async=\"\" src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n\n\n\n<p>\u201cThis took place alongside other attacks on civilians, including those queuing for food; obstruction of aid delivery by humanitarian agencies; and attacks on and killing of aid workers, which forced many agencies to cease or limit their operations in Gaza,\u201d he said in his statement adding that Israel\u2019s siege of the Gaza Strip by closing the border crossings and restricting the transfer of food, water, and medical supplies was part of an Israeli plan to use starvation as a \u201cmethod of war\u201d.<\/p>\n\n\n\n<p>Although Israeli Prime Minister Benjamin Netanyahu and Defense Minister Yoav Gallant are not facing immediate arrest, the announcement by the ICC\u2019s chief prosecutor dealt a symbolic blow to their stature in the international community, further isolating Israel amid the Gaza conflict.<\/p>\n\n\n\n<p>Israel is not a member of the International Criminal Court, so even if arrest warrants are issued, Netanyahu and Gallant would not be immediately prosecuted at ICC. They include Sir Adrian Fulford, a former ICC judge;  Baroness Helena Kennedy;  Elizabeth Wilmshurst; Theodor Meron, former president of the International Criminal Tribunal for the former Yugoslavia; and human rights lawyer Amal Clooney. <\/p>\n\n\n\n<p><br><strong>Israel\u2019s response<\/strong> <strong>to arrest request<\/strong><\/p>\n\n\n\n<p>Israel\u2019s leadership had been working through diplomatic channels to prevent the issuance of the ICC warrants since the case was brought to the platform. Netanyahu denounced the prosecutor\u2019s accusations against him as a \u201cdisgrace\u201d and an attack on the Israeli military and the entire nation. (Image Credit: Reuters\/Amir Cohen)<\/sup><\/em><\/figcaption><\/figure>\n<\/div>\n\n\n<p>Opposition leader Yair Lapid called the decision a \u201cdisaster\u201d, while far-right Finance Minister Bezalel Smotrich said the decision was a \u201cshow of hypocrisy and Jew-hatred\u201d.<\/p>\n\n\n\n<p><strong><br>Biden calls ICC arrest request \u2018outrageous\u2019<\/strong><\/p>\n\n\n\n<p>U.S. President Joe Biden also lashed out at the prosecutor for putting Israeli leadership and Hamas on the same page. He supported Israel&#8217;s right to defend itself against Hamas. President Biden said the ICC prosecutor\u2019s desire to arrest Netanyahu and Gallant was \u201coutrageous,\u201d adding \u201cWhatever this prosecutor might imply, there is no equivalence, none, between Israel and Hamas.\u201d He reiterated that the United States \u201cwill always stand with Israel against threats to its security.\u201d<\/p>\n\n\n\n<p>U.S. Secretary of State Antony Blinken said that the United States rejects the ICC prosecutor&#8217;s application for arrest warrants for Israeli officials and Hamas. \u201cWe reject the Prosecutor\u2019s equivalence of Israel with Hamas. It is shameful,\u201d he said in a <a href=\"https:\/\/www.state.gov\/warrant-applications-by-the-international-criminal-court\/\" target=\"_blank\" rel=\"noreferrer noopener\"><mark style=\"background-color:rgba(0, 0, 0, 0);color:#ac0707\" class=\"has-inline-color\">statement<\/mark><\/a>, adding that \u201cthe United States has been clear since well before the current conflict that the ICC has no jurisdiction over this matter.\u201d<\/p>\n\n\n\n<p>Blinken further said the move could jeopardize diplomacy for a ceasefire and a hostage deal between Israel and Hamas.<\/p>\n\n\n\n<p><br><strong>Hamas\u2019s response<\/strong><\/p>\n\n\n\n<p>Hamas also denounces the ICC prosecutor\u2019s request to arrest its leaders. A statement by Hamas said that &#8220;the attempts of the Prosecutor of the International Criminal Court to equate the victim with the executioner by issuing arrest warrants against a number of Palestinian resistance leaders.&#8221;<\/p>\n\n\n\n<p>The ICC, located in the Hague, Netherlands, has the authority to bring charges against individuals for war crimes and related offenses. It operates independently from the International Court of Justice (ICJ), which adjudicates cases between states.
